Virginia is now accepting Bills for advance introductuion as of July 23, 2000. Anyone may contact their Representative or Senator, and ask them to introduce, or co-spnsonsor a bill. Virginia HB 1021-2000 contained several provisions for the fuller utilization of alternative programs through proportinal suspension of sentence. It will probably be best to break the provisons out into separate bills, so that they can be conceptualized as separate issues by the Courts of Justice Committee.
The Bill for the U.S. Congress has not yet been introduced, so meetings can be held with congressmen and their staff, at any time, to find co-sponsors.

Further future meetings are listed below.*************************
News reports in the media often report on further crimes committed by recidivists, but fail to ask why the particular offender had not been given an adequate incentive to participate in an effective alternative program, before being returned to our communities. Judges, prosecutors and legislators, who could have reduced the likelihood of any further criminal acts, which are now in the news, are rarely interviewed about the opportunity that was missed, for utilizing effective rehabiliation programs, that can reduce recidivsm from 70-% to 14 percent for serious drug offenders. *************************
News media reports of crimes by recidivists should report the role that each decision maker played in the circumstances which caused the failure of untiling effective therapeutic community programs, at the previous sentencing hearings for that offender, who is now in the news. The news media should conduct intrerviews with those in the chain of the decison not to offer adequate incentives, and report what changes are being made to correct the lack of recidivsm reduction. The news should be what the judges, prosecutors, legislators, county board supervisors, community service board members, and defense attorneys, who were responsible for missing an oportunity for rehabiliation, are doing now to improve the handling of their responisibilities. ********************************************************** In the AOL publish program, paragraphs cannot be created, so astericks have been used to demark breaks in the text.
Virginia 2000 H.B. 1021 House Bill 1021 provides for the proportional suspension of sentence, of up to 3 years, so that an offender can receive funding for the cost of the program, capped at half the cost of the suspended term of impriosonment. The number of days that an offender spends in the program approved by the sentencing judge, counts toward the portion of the sentence that was proportionally suspended. The sentencing judge specifies the number of days of prison credt to be earned for each day of participation in the alternative program. Depending upon the effectivenss, expense and punitive value of the program, the judge may suspend very little imprisonment time, or up to 3 years.

To support H.B. 1021, you may call the Virginia State Crime Commission at (804) 225-4534. Anyone may get on the mailing list for receiving agendas and dates and locations of upcoming public hearing meetings of the Crime Commisison, ask for Sylivia. Rich Savage, Director, is apparently the only staff member with information on H.B. 1021. The Criminal Justice subcommittee had suggested a letter study be done by the Crime commission, but this was not recorded, and not being done, at least not fomrally.

The Fairfax County Board of Supervisors has open public comment on Monday, October 20, 2000, at 5 pm, The County Board can give persuasive suport in Richmond. *************************************************** Cure Board Meeting, Saturday, September 23, 2000, in Richmond in the State Assembly Building at 9:30 AM. Families of prisoners can lobby to suport HB 1021.
Delegates may submit new bills as early as October, 2000. the deadline for further new bills is January, 2000. Specific dates will be set in April, 2000. Concepts which could be added to HB 1021, in the form of additonal bills, would be: 1. Specific Admissability of evidence and studies on Recidivism at sentencing. 2. Override of of manatory minimums to allow 3 years of a proportionally suspended sentence. 3. A provision permitting the offender not to have to admit to substance abuse for the court to grant a rehabiliative alternative. 4. Extending the time limit for sentencing so that the judge could consider a proportionally suspended sentence, up until the last day of imprisonment.
These 4 provisons were in H.B. 1021 up until the hearing on February 8, 2000, when they were deleted by amendment. These, or other provisions, can be added after November 2000, by a bill introduced by any delegate. ************************
